Terms of Service

These terms govern your use of Zmooz at https://zmooz.com and the Zmooz Connect WordPress plugin (together, the "Service"), operated by Zmooz ("we", "us"). By creating an account or using the Service you agree to them. Questions: legal@zmooz.com.

1. The Service

Zmooz converts website designs you upload into WordPress block themes, lets you download them, and — through the Zmooz Connect plugin — installs them on a WordPress site you control and imports their content. Zmooz is an independent product and is not affiliated with, endorsed by or sponsored by Anthropic or the WordPress Foundation.

2. Your account

You sign in with a Google or GitHub account. You must be at least 16 and able to enter a contract. You are responsible for activity under your account and for keeping your sign-in provider secure. Tell us at legal@zmooz.com if you suspect unauthorised use.

3. Credits, payment and refunds

Conversions cost credits. Credits are bought through Stripe at the prices shown at checkout, are tied to your account and cannot be transferred or exchanged for cash. If a conversion fails, its credits are returned to your balance automatically. Where the law gives you a right to a refund we honour it; other refund requests for unused credits are reviewed case by case — email support@zmooz.com. Prices may change; changes never affect credits you already hold.

4. Your content and what you own

You own the designs you upload. You give us a licence to store, process and transform them only as needed to provide the Service, including the automated AI processing described in our Privacy Policy. You confirm you have the rights to every design you upload.

You own the generated theme. Because WordPress requires GPL-compatible themes, we deliver generated themes under GPL-compatible terms, so you may use, modify and distribute them freely. The Zmooz Connect plugin is free software licensed under the GPL, version 2 or later. The Zmooz service, its converter and its website remain our property.

5. Acceptable use

You must not:

  • upload designs or content you do not have the right to use, or that is unlawful, defamatory or infringes someone's rights;
  • upload malware or use the Service to distribute it;
  • attempt to bypass credits, rate limits or access controls, or to probe, scrape or reverse-engineer the Service;
  • use the Service to build something that competes with it by copying its output at scale;
  • resell access to the Service without our written agreement.

6. Automated output

Conversion is automated and may not reproduce every design exactly. Review the generated theme before publishing it. You are responsible for the site you publish, including its content, accessibility and compliance.

7. Your WordPress site and third-party services

The WordPress site you deploy to is yours: its hosting, backups and security are your responsibility. Payments are subject to Stripe's terms; signing in is subject to Google's or GitHub's terms.

8. Availability and changes to the Service

Zmooz is an early-access product. We may change, suspend or discontinue features, and we do not promise uninterrupted availability. Generated themes are deleted after the download window shown on your dashboard — keep your own copy.

9. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the extent the law allows.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential loss, lost profits or lost data, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, and nothing removes rights you have as a consumer.

11. Termination

You can stop using the Service at any time and ask us to delete your account at privacy@zmooz.com. We may suspend or terminate accounts that break these terms; unused credits on an account terminated for breach are forfeited. Sections 4, 9, 10 and 12 survive termination.

12. Governing law and disputes

These terms are governed by the laws of the country in which Zmooz is established, without regard to conflict-of-law rules, and disputes are heard by the courts there — unless you are a consumer entitled to the law and courts of your home country, in which case those apply. We will try to resolve any dispute informally first: write to legal@zmooz.com.

13. Changes to these terms

We may update these terms. We update the date at the top and, for significant changes, notify you by email or in the app before they take effect. Continued use after that date means you accept the new terms.
